Everyone knows just how important background checks are in ensuring ones own safety and protection. Everyday, we face new people, interact with several faces at one time, and work with many individuals who are strangers. Theres no knowing whether these persons can be trusted. And theres no knowing whether these persons have a propensity to a particular crime. Also, we have no assurance whatsoever that they wont commit the same act of crime against you. So, the best option for us therefore is to conduct background checks.
One of the important information needed in conducting background checks is the criminal record of a person. In North Carolina, most of the NC criminal records of individuals are available or accessible to the general public. This makes it easier for any business, organization, or government agency to get hold of NC criminal records.
The information contained in NC criminal records play a huge part in ones judgment of a persons character. Also, NC criminal records helps employers make better-informed decisions concerning the hiring of an individual with less than perfect record. Due to many occurrences of incidents where no background check or no research on the NC criminal records of a prospective hire was done, many employers have grown more concerned in this particular area of the hiring process. Thus, more and more companies now require comprehensive pre-employment background checks and NC criminal records.
How NC Criminal Records are made
NC criminal records are established when a person gets the following penalty:
Suspended sentence or unconditional sentence of imprisonment The court has the power to suspend the passing of sentence when there is no minimum punishment prescribed by law. Suspension of sentence stretches for a period of three years generally. During this time, the offender is released on probation.
NC criminal records are still established even when sentence is suspended. These types of NC criminal records are usually not included in the state criminal history registry; hence, they are also not included in the FBI database.
Community Service A person may perform a service in order to benefit his or her community. Often, this type of service is done in connection with projects by various youth organizations, such as the Boy Scouts. In some cases, however, community service may also be used as an alternative sentencing technique in the justice system. NC criminal records are still established even when the court sentence does not involve incarceration for a certain period of time. The NC criminal records in this case arent stored in the state registry but are still available as a criminal court filing.
